| this should remain a cigarette only issue. I would assume MD understands they cannot expand definitions of tobacco product manufacturer beyond cigarettes without risking their MSA payments. Frankly, I think what they are doing here would risk their MSA payments, but they could argue they need to do this to show they are enforcing against NPMs.
This issue has been coming up in the cigarette space more often as cigarette market share declines thereby having the effect of declining MSA revenues. Given how much the states have leveraged against MSA revenues ? it?s an issue.
